WHAT IS MEDIATION?
Mediation is a cost effective approach to the resolution of disputes. It involves a neutral facilitator whose obligation is to assist the disputing parties in a private and confidential setting to reach a long-lasting resolution satisfactory to all parties. The process is flexible and allows parties to maintain control over the outcome of the resolution. Mediation is not the answer to every conflict, but is effective in resolving a significant number of disputes. AREAS OF MEDIATION PRACTICE Resolution Through Mediation provides mediation service for disputes in the following areas: Divorce and Family Issues; Injury Cases; Business & Control Issues; Commercial, Contract and Landlord/Tenant Disputes; Zoning & Land Use Matters; Neighborhood/Association Disputes; and General Legal Issues. Each mediator is a practicing attorney at Farrell, Guarino & Boccalatte, P.C. a full service law firm with offices in Middletown and Clinton. With over 60 years combined experience, much of it handling litigation matters. Each mediator holds a certificate in mediation training, and has participated in resolving numerous disputes through mediation. While courts will always be essential to our justice system, quicker and less expensive alternatives for the resolution of disputes is a concept whose time has come.

DIVORCE MEDIATON Mediation is a process for couples, who have made a decision to divorce. Couples come to mediation, who are in agreement on most of the issues they need to resolve and couples come to mediation who are in high conflict. The Mediation Process can provide valuable assistance to a wide range of couples. For couples who believe they have reached agreement on the issues of their divorce, mediation can insure that the parties have addressed all the issues which must be discussed and understand the ramifications of their decisions. For parties in conflict, the Mediation Process, assist couples in clearly identifying their respective issues of conflict, prioritizing their goals and needs, creating options for settlement which address each parties’ goals and needs, and negotiating a final settlement. While our divorce mediators are family law attorneys with extensive experience in all aspects of family law and the Court System, our mediators are not providing individual advice to either party on their respective legal rights and obligations. Mediation clients are encouraged, but not required to seek independent legal advice from review counsel. The participation of review counsel is respected in the mediation process. Our divorce mediators also recognize that at times, the parties will be best served by the use of outside professionals with expertise knowledge such as child specialists for creating parenting plans or accountants and valuators for issues involving business interests owned by the parties.
